Lawyers seek CJI’s help to resolve row with Court

New Delhi: The Tamil Nadu Advocates’ Association on Friday sought the intervention of Chief Justice of India K.G. Balakrishnan to resolve the row between lawyers and the Madras High Court on permitting ministerial staff with law degrees to apply for the post of District Munsif-cum-Judicial Magistrate (DMJM).
In a memorandum sent to the CJI, association president S. Prabhakaran said the Full Court of the Madras High Court decided to amend the service rules regarding recruitment to the post of DMJM to enable ministerial staff to apply. It said: “It has been the traditional requirement that the applicant for the post of DMJM should have at least four years of actual experience in the Bar. This Bar experience provides them continuous training in practical application of law to human problems.” While so, the decision of the Full Court to allow ministerial staff without practical experience to apply would affect the independence of the subordinate judiciary, the memorandum said.
