Court stays further acquisition proceedings

BANGALORE: The Karnataka High court on Tuesday stayed all further proceedings by the State Government and the Karnataka Industrial Areas Development Board (KIADB) on the acquisition of hundreds of acres of land in Bandikodigehalli Palya, Singahalli, Arebannimangala and surrounding villages in Devanahalli taluk near Bangalore.

Justice Huluvadi G. Ramesh passed the interim order of stay on petitions by B. Anjanappa, G. Aruna and several other petitioners.

The petitioners said many of them are farmers in Devanahalli taluk. They said they had questioned the action of the authorities in acquiring valuable agricultural and farmland for industrial purposes.

They said the State had arbitrarily decided to acquire1,419 acres in Bagalur, Huvinayakanahalli, Bandikodigehalli and Kahadevakodigehalli villages in Devanahalli taluk for setting up a hardware park.

The State had also decided to acquire 1,209 acres in Bandikodigehalli Palya, Singahalli and Arebannimangala villages for setting up industries.

They said the action of KIADB, in issuing notifications to acquire their lands, was flawed and illogical. They said there is no logical reason for the State to deprive farmers of their livelihood by acquiring their lands.

Justice Ramesh sought to know from the KIADB on whether it had obtained Government and Cabinet approval for acquiring the lands. The KIADB said it had only issued a preliminary notification and the petition is, therefore, misconceived. It said it had sought Government approval for acquiring the lands for industrial purposes.

The court, however, decided to pass an interim order and adjourned further hearing on the case.
