NEW DELHI: The Centre has virtually informed the Delhi High Court that it will not exempt daily commuters from toll for using the Delhi-Gurgaon expressway, submitting that it had the power to impose it. Counsel for the Government made the submission while arguing for dismissal of a public interest litigation seeking relief for daily commuters on the ground that the commuters did not have an alternative road to avoid toll. Counsel submitted that the daily commuters could use the Mehrauli-Gurgaon road to avoid payment of toll. Observing that the Court would not intervene in the Government’s policy decision to collect toll from the users of the expressway, a Division Bench comprising Justice A.P. Shah and Justice S. Muralidhar said it would examine the limited question of whether the Government had the power to collect toll from the users. The petitioner, Vivek Bharat Ram, submitted that the daily commuters should either be exempted from toll or alternative roads should be built for them so that they could travel to and from Gurgaon without having to pay toll twice a day.
