BANGALORE: The Karnataka High Court on Thursday adjourned by three weeks hearing on a public interest litigation (PIL) petition by CMH Traders and Residents Association of Indiranagar, Bangalore, challenging the acquisition of their land and premises for the Bangalore Metro project. The petitioners also filed an interlocutory application (IA) seeking a stay on the project. They contended that the Metro project should be taken up under the Railways Act and not under the Mysore Tramways Act as is being done now. Besides, the Metro would be able to attract more traffic if the alignment was shifted from CMH Road to Old Madras Road. Moreover, environmental clearance was not taken for the project, they said. In its counter, the Bangalore Metro Rail Corporation Limited (BMRCL) not only ruled out any change in the alignment of the metro project, but also said that there was no need for obtaining environmental clearance for the metro project. It said that the metro project, taken up under the Tramways Act, did not need environmental sanction. Assistant Solicitor-General Aravind Kumar, who appeared on behalf of the Centre, sought time to file objections. A Division Bench comprising the Acting Chief Justice, Deepak Verma and Justice A. S. Bopanna adjourned further hearing on the case by three weeks.
