Kozhikode: K.V. Gopikuttan, Chief Judicial Magistrate, Kozhikode, on Saturday, posted to August 14 trial of a case against M. Veerappa Moily, general secretary, All India Congress Committee, on the charge of violating the Representation of the People Act. Summons issuedThe court issued summons to the former District Collector Rachna Shah, first witness in the case. The Kerala-cadre Indian Administrative Officer, who is on deputation, is now in Vienna, Austria. ViolationThe Kasaba police had registered the case based on a complaint filed by Ms. Shah that Mr. Moily had violated Section 126 (prohibition of public meetings during a period of 48 hours ending with the hour fixed for conclusion of poll) of the Act. The charge sheet says Mr. Moily held a news conference in the city on the eve of the Assembly polls on April 28, 2006. Affidavit filedLast month, the court exempted Mr. Moily from personal appearance in the proceedings. His lawyers, P.M. Niyas and P.T. Rajesh, had filed an affidavit under Section 205 (magistrate may dispense with personal attendance of accused) of the Code of Criminal Procedure.
