MADURAI: The Madras High Court Bench here on Friday dismissed a writ petition filed by a maize exporter of Tuticorin alleging that large export houses alone were being exempted from the ban on cereal export. Justice P. Jyothimani said he did not find any illegality in the exemption granted to the large export houses, as they had partially loaded the ships at the Kakinada, Jamnagar and Kandla ports, obtaining ‘Let Export Order’ from the Customs. It was not done in the case of the petitioner’s consignment. He pointed out that article 1.2 of the Handbook of Procedure on Foreign Trade Policy says: “Wherever procedural/policy provisions have been modified to the disadvantage of exporters, the same shall not be applicable to consignments already handed over to the Customs for examination.” The Director-General of Foreign Trade, in a counter affidavit filed on his behalf, said the government’s decision to ban maize export was guided by public interest, besides the continual assessment of price situation and demand and supply in domestic and international market.
