HC quashes defamation case against Bal Thackeray

Mumbai: The Bombay High Court on Monday quashed a defamation case against Shiv Sena chief Bal Thackeray and two others in a 1996 suit pending before a magistrate court.

Mr. Thackeray, along with Sanjay Nirupam, then Editor of ‘Dopahar Ka Saamna,’ now in Congress, and Subhash Desai, its publisher, had moved High Court in 1998 seeking to quash the defamation case filed by an Ulhasnagar-based lawyer. Justice Abhay Oka observed that “this is a fit case for quashing,” adding that it was an old case and whatever was reported was based on court proceedings.

The article was titled ‘Ek Anpad Nagaradhyaksha Ki Bebasi’ (The Helplessness of an Illiterate Chairman of Municipal Council). The case was between Ambarnath Municipal Council and a private firm, Mukund Engineering Limited.

The paper had published excerpts from an affidavit filed by Dadasaheb Kamble, then Chairman of the Ambarnath Municipal Council, in Ulhasnagar Metropolitan Court.

Mr. Kamble, in his affidavit, had alleged that the advocate for Mukund Engineering had misguided him about the facts of the case, which were later used against him.

These facts from the affidavit were reported in the newspaper. After reading the report, one of the advocates representing the private firm filed a defamation suit against the trio. — PTI
