Amendment to recruitment rules needed: Bar Association

PUDUCHERRY: The Pondicherry Bar Association on Friday demanded amendment to the Puducherry Judicial Service (Cadre and Recruitment) Rules 2008 issued recently.

In a memorandum submitted to the Lieutenant Governor, general secretary of the association M.S. Marudhupandiyan said the provision to provide an opportunity to “law graduates working in Group A, B and C posts in any Court of Law in Tamil Nadu” for appointment of Civil Judge (Junior Division) would infringe upon the rights of persons who have enrolled themselves in the State Bar Council as advocates and “paves way for persons who do not have experience in conducting cases.”

Separate memorandums were handed over to Chief Minister N. Rangasamy and Law Minister E.Valsaraj, association sources said.

The memorandum said a similar provision advertised for the selection of the Civil Judge (Junior Division) in the Tamil Nadu State Judicial Service had been suspended by the High Court.

The association appealed to the Lt. Governor to direct the deletion of the provision from the Rules to maintain “integrity and efficiency” of the judiciary. They also wanted preference to advocates who had their residence at Puducherry in the appointment to the Puducherry Judicial Service. “It is pertinent to point out that residents of Pondicherry are not considered in the selection of judicial officers at Tamil Nadu,” the memorandum said.

The association also demanded relaxation of age limit in the selection of Civil Judge (Junior Division) under the Puducherry Judicial Service (Cadre and Recruitment) Rules, 2008 in the manner followed by the Tamil Nadu Government for similar posts. The age requirement for the direct recruitment of District Judge under the Rules should be amended, it said.
