Job of court commissioners legal: Lawyers
New Delhi: Lawyers assigned the task of court commissioners by the Delhi High Court to monitor MCD’s demolition drive against illegal construction in the Capital on Thursday justified their appointment and said it was well within the provisions of law.
Appearing before the Division Bench of Justice Mukul Mudgal and Justice Manmohan, counsel Kirti Uppal and Rakesh Khanna countered the MCD’s argument that the appointment of nine advocates as court commissioners by the Bench means setting up a parallel body of the MCD.
MCD plea
The lawyers’ argument was in response to an application filed by MCD through senior advocate and former law minister Ravi Shankar Prasad challenging the power delegated to court commissioners by the High Court in connection with the demolition case.
In July 2006, while hearing a petition seeking directions to the civic agencies to remove illegal encroachments for decongestion of the city, the Bench had appointed the court commissioners to personally visit their respective zones and monitor the demolition drive against illegal constructions.
