Transfer is no remedy, court tells NICE

New Delhi: The Supreme Court on Monday rejected at the admission stage a petition filed by Nandi Infrastructure Corridor Enterprise (NICE) seeking transfer of its writ petition, pending in the Karnataka High Court, to the apex court.

Earlier, senior counsel Dushyant Dave, appearing for NICE, said substantially the same questions of law were involved in this writ petition and similar matters pending in the Supreme Court.

Moreover, even after a contempt notice, the Karnartaka government had not followed the Supreme Court order to implement the Bangalore-Mysore Expressway Project, counsel told a Bench consisting of Justices B.N. Agrawal and G.S. Singhvi.

Senior counsel K.K. Venugopal, appearing for Karnataka, said 18 petitions involving similar issues were pending in the High Court and there was no reason to transfer the petititon of NICE.

Justice Agrawal told Mr. Dave: “If it is your contention that similar matters are pending here and that the matter should be transferred to this court, then the Supreme Court will be flooded with hundreds of petitions. Transfer is not the remedy. You tell the High Court that similar matters are pending in the Supreme Court. We cannot entertain such petitions as there will be no end to it.”
