Chandigarh: The Haryana Cabinet on Tuesday approved amendment of the Haryana Public Premises and Land (Eviction and Rent Recovery) Rules, 1973, on the basis of the recommendations of the Committee on Subordinate Legislation of the Haryana Vidhan Sabha. According to the amendment in Rule 4, in case a person on whom the notice is to be served under Sub-Section(I) of Section 4, or of Section 6 of the Haryana Public Premises and Land (Eviction and Rent Recovery) Act, 1972, and he cannot be found, a copy of the notice would be sent by registered post with acknowledgment to the person at the first instance at his usual and last known place of residence or business. In case the notice cannot be served to the person concerned, it would be delivered to any other adult member of his family. Also, signatures of that person would be obtained in token of acknowledgment of service. In case of refusal or when the person concerned cannot be found, the notice would be affixed on the outer door or some other conspicuous place on the last known place of residence or business in the presence of two witnesses. Ad in newspaperIn case the notice is not served by the above mentioned modes of service, its contents would be circulated through a local newspaper or a proclamation be made by the beat of drum in the locality. Rule 6 pertaining to taking possession of the public premises has been broad-based further. An unauthorised person has been given reasonable opportunity of being heard and a notice containing order of eviction by the collector shall be served upon or communicated to him or displayed or affixed on the conspicuous part of the public premises or ordinary place of residence or business to vacate the public premises within 30 days.
