SC issues notice on imposing tax on ATMs

J. Venkatesan

New Delhi: The Supreme Court on Wednesday issued notice to the Andhra Pradesh government on a petition questioning the constitutional validity of imposing profession tax on Automated Teller Machines (ATMs) and Extension Counters of the branches of the banks in the State.

A Bench of Justice S.H. Kapadia and Justice B. Sudershan Reddy, after hearing senior counsel T.R. Andhyarujina and senior counsel A.V. Rangam, issued notice on the special leave petition filed by State Bank of Hyderabad against a judgment of the Andhra Pradesh High Court upholding the levy. The Bench restrained the government from executing the demand notice for Rs. 1, 12,500 sent to SBH imposing such tax on the bank’s 375 ATMs and 31 Extension Counters in the State and further demanding interest of Rs. 36,818.
