Biranchi murder case: police file chargesheet against Acharya

BHUBANESWAR: After carrying out a sustained investigation, the twin-city police commissionerate has finally filed a chargesheet in the sensational Biranchi Das murder case holding gangster Raja Acharya as the principal accused.

“Investigation clearly revealed that the principal accused in the case, Acharya viewed Biranchi Das as an obstruction in his personal relationship. Hence he decided to take revenge on Das and committed the murder,” the police said.

The chargesheet, which was filed before the court of Sub-Divisional Judicial Magistrate Arun Sahu, said the gangster committed the crime in association with his accomplice Chagala alias Akshaya Behera.

“Enough oral, documentary and forensic evidence have been brought out during the course of investigation and chargesheet has been laid in the court of SDJM, Bhubaneswar,” office of the police commissioner said.

The accused were charged under Sections 302, 120-B, 34 IPC read with Sections 25 and 27 Arms Act, 1959, it said. The police, however, said the investigation had not been closed.

“Further investigation of the case is continuing under Section 173(8) CrPC and as and when additional evidence against the accused surfaces, the same shall be laid before the court,” the commissionerate said.

The police claimed that this was the first case in which voice spectrographic test was conducted in Orissa to establish evidence against Acharya in terms of his motive to kill Das.

Police administration was under pressure over conducting the investigation into the murder. At least four IPS officers, including the then Commissioner of Police Binay Behera, were transferred and some police officials were shifted from their places of posting during the investigation of the case.

Motives

Different motives highlighted by media were looked into during the investigation. Besides the motive of personal animosity of Acharya with the victim as claimed by the police commissionerate, land deal, embezzlement of funds received towards welfare of marathon kid Budhia Singh and railway scrap smuggling were other reasons which had come to the light.

Moreover, music video actresses Leslie Tripathy and Bidusmita Tripathy and album coordinator Jubilee Sundaray got entangled in the case over their alleged association with the prime accused. Finally, the chargesheet was submitted on Saturday.

Ironically, a couple of days before the police filed the chargesheet, Gitanjali Panda, widow of Das, sought special prosecutor demanding ensure of fair trial in the case. At present, the principal accused is lodged in Bolangir district jail.
