“Had respondents followed policy decisions, the petitioner might have been selected as bus conductor” CHENNAI: Transport corporations which are fully owned by the Tamil Nadu Government are not following the government’s two policy decisions, the Madras High Court said on Tuesday. In his order directing the Metropolitan Transport Corporation (MTC) to appoint a destitute widow as a conductor within two weeks, Justice N. Paul Vasanthakumar said the first one was not providing 30 per cent of conductor posts to women candidates as laid down in a G.O. of February 1989. The second related to failure to follow the rule of reservation in giving appointment to destitute widows. “At least in future, the government must see that those policy decisions are implemented by the transport corporations and by the public sector undertakings.” Mr. Justice Vasanthakumar said had the respondents, the MTC, represented by its Joint Managing Director and the General Manager of the corporation, followed the policy decisions, the petitioner, B. Kali Jothi, might have been selected as conductor as she was eligible to be appointed for the post. The Judge applied the principle laid down by a Division Bench in another case to the present case and said the petitioner had appeared for interview for which 75 conductor posts were reserved for women candidates. However, only three candidates were appointed. She was denied appointment only on the ground that she had not secured the minimum of five marks in the interview. Having regard to the fact that no minimum marks was prescribed under any rule for selection to the post of conductor, the non-selection of the petitioner to the post was to be treated as illegal, the Judge said.
