High Court warns State not to defy its orders

Police fail to submit a report on the death of BSP worker


BSP worker’s wife has accused Shivakumar and his brother of involvement in the murder

She has charged the Kanakapura police of not properly investigating the case


BANGALORE: The Karnataka High Court expressed anguish at the manner in which the State police failed to place a report before it relating to the death of a Bahujan Samaj Party (BSP) worker and warned the State Government that it would order a Central Bureau of Investigation (CBI) probe into the case if the State and the police continued to “dodge” or defy the orders of the court.

Justice Jawed Rahim made the observation on a petition by Roopli Bai of Kodihalli village in Kanakapura taluk of Bangalore district. Ms. Roopli Bai had alleged that Congress MLA from Sathnur and former Minister, D.K. Shivakumar, his brother D.K. Suresh and others were involved in the murder of her husband.

She alleged that the Kanakapura police had failed to properly investigate the case as Mr. Shivakumar was one of the accused. She urged the court to direct the police to arraign as accused both Mr. Shivakumar and Mr. Suresh.

Ms. Roopli Bai said she wanted the CBI to probe the murder as she had no faith in the local police. She also alleged that the police were not investigating the murder.

Ms. Roopli Bai said she filed the petition in 2004 after her husband, Nagaraja Nayak, was murdered on September 27, 2003 by some persons. She said that her husband, before his death, had claimed that Mr. Shivakumar and Mr. Suresh were trying to get him killed.

She said that after her husband’s murder she had gone to the Kodihalli police to register a complaint. She alleged that though she had named several persons in the murder, the police had not entered them in the FIR and instead entered names of their choice. She said she was “forced” by the police to sign the complaint in which the persons she had accused of murder did not figure.

She urged the court to direct the State to order a CBI probe into the murder.
