“In case the film is not released, it shall not be released until further orders” New Delhi: The Supreme Court on Friday afternoon stayed the release of Tamil film ‘Nayagan,’ if it had not been released earlier in the day. The film was scheduled for release on Friday. While senior counsel for the petitioner, Mukul Rohatgi, submitted that the film was to be released later in the day, counsel S. Nandakumar, on behalf of the producer, submitted that the film was released in the morning itself. Taking into consideration the rival submissions, a Bench of Justice Dalveer Bhandari and H.S. Bedi in its order passed around 1 pm said “Issue notice. In the peculiar facts and circumstances of the case, it becomes imperative to pass an order. We are passing this order at 1 pm, in case the film is not released, it shall not be released until further orders. Counsel for the respondent will seek instructions and list this case after two weeks.” The petitioner, Vinitha Associates Ltd., alleged that it had financed Rs.1 crore to the first respondent, V.K. Vijayakumar Reddy, to meet the production expenses of the film. It was agreed that Mr. Reddy would make the payment before the film’s release. Even as he announced the release, cheques issued by him bounced.
