No land sale without court nod, APHB told
Hyderabad: A division bench of the High Court comprising Chief Justice Anil R. Dave and Justice Vilas Afzulpurkar on Thursday made it clear that the A.P. Housing Board shall not confirm any sale of its lands without permission from the court.
The Bench was passing these interim orders in a writ petition filed by Captain Lingala Panduranga Reddy and Pattana Nivasula Hakkula Porata Samiti.
The writ petitioners challenged the notification issued by the Housing Board putting 55 acres of land within the limits of Greater Hyderabad Municipal Corporation for sale. They said that the Board cannot sell lands like this in the name of business. The provisions of the Housing Board Act were placed before the court. They provide for building schemes and not sale of bulk lands. The upset price for each acre ranged from Rs. 3 crore to Rs. 10 crore. They sought cancellation of the notice and requested the court to stop the auction to be held on August 25 through e-tendering. The Bench asked the government and the Board to file counter affidavits and granted interim orders and adjourned the case.
