HC serves notice on fire force, MCC over college building

Fire force finds fault with building plan


BANGALORE: The Manipal Academy of Higher Education (MAHE) and the Kasturba Medical College, Mangalore, have petitioned the Karnataka High Court against an order of the Mangalore City Corporation (MCC) asking them to demolish new buildings at their educational complex in Attavar near Mangalore.

In the petition, MAHE said it had been accorded a deemed university status, several years ago. It had started a college of dentistry in 1987. It sought permission from the Dental College of India (DCI) and the State Government to start new courses in dentistry.

Permission granted

The State Government, MAHE said, issued the essentiality certificate, permitting the college to start new courses and construct additional buildings for housing the blocks offering the new courses. The academy submitted a form, detailing its plans to construct additional dental blocks at Attavar.

When the construction work was started on the Attavar campus, the chief fire officer of the Fire Force and Emergency Services visited the site and asked the college authorities to modify the construction. The academy said it had partially carried out the modifications suggested by the officer. However, the regional fire officer refused to issue a no-objection certificate for the college authorities to continue the construction. Subsequently, the MCC issued notices under Section 321 of the Karnataka Municipality Act to both MAHE and the college asking them to not only stop further construction but also demolish whatever had been constructed.

Both MAHE and the college have urged the High Court to direct the Fire Force and Emergency Services to issue no-objection certificate. They have questioned the decision of the corporation in issuing a show-cause notice to them, seeking demolition of the new buildings.

Justice N.K. Patil ordered that notices be issued to the Director General of Police, Fire Force and Emergency Services, and the MCC. Hearing has been posted to September 12.
