Writ petition challenges jurisdiction of sub-court

MADURAI: A writ petition has been filed before the Madras High Court Bench here to quash a Government Order (G.O.) issued on July 26 shifting the jurisdiction over District Munsif Courts at Bodinaickanur and Theni from the Periyakulam sub-court to the Theni sub-court.

A Division Bench comprising Justice P.K. Misra and Justice K. Kannan directed the Special Government Pleader to obtain instructions from the State Government as well as the Registrar General of the High Court and adjourned the matter to Tuesday. The Periyakulam Bar Association, represented by its secretary T. Ambhashankar said that Periyakulam sub-court was constituted in 1981. It exercised original and appellate jurisdiction over the Munsif Courts at Theni, Andipatti, Bodinayakannur, Periyakulam and Uthamapalayam.

In 2006, a combined court building was established at Lakshmipuram in Theni comprising a Munsif Court, a Magistrate Court, a Chief Judicial Magistrate Court and a Principal District Court. Subsequently, in 2003, the State Government sanctioned a sub-court too for Theni. However, the Uthamapalayam Bar Association submitted a representation to establish the sub-court in their area because the distance between the Periyakulam sub-court and the proposed sub-court in Theni would be just seven kilometres. The Registrar General too agreed with the submissions.

The Government dropped the idea of establishing the sub-court in Theni and instead constituted one at Uthamapalayam. But to the surprise of many, the latest G.O. had been issued establishing another sub-court at Theni and shifting the jurisdiction over three Munsif Courts to the new court.
