Woman fined for failure to record evidence

NEW DELHI: The Delhi High Court on Thursday imposed a fine of Rs.50,000 on a woman for her failure to record her evidence in a divorce case despite the trial court giving her several opportunities to fulfil the mandatory formality.

The woman, Sujata Aggarwal, had challenged the trial court decision in the High Court submitting that it had denied her a rightful opportunity to record her evidence in the case.

Contempt of court

After giving her several opportunities, the trial court had refused to record her evidence saying that her conduct had been contemptuous of the court.

In his order, Justice S. N. Dhingra directed the woman to deposit the fine amount with the Delhi High Court Legal Services Authority.

The woman’s husband, Ravishanker Aggarwal, had filed a petition in 1998 seeking divorce from his wife. The divorce case is still going on in the trial court.
