Judicial appointments

The article, “Primacy of executive, a dangerous move (October 22),” was well-intentioned and thought-provoking. In a country like India, it is not enough for the judiciary to be independent. The judges must be seen to have integrity and noble qualities of mind and heart and, above all, the courage of conviction. The collegial selection has merits as well as demerits but is superior to the previous system of primacy of the Executive.

Anil Divan’s arguments that appointments to the higher judiciary can never be safely entrusted to coalition governments is blatantly untenable. Even if it is a coalition set-up, it is the will of the people who wanted to be governed that way. How can people’s mandate be subjugated on a pretext? Our Constitution does not differentiate between a single-party government and a coalition government.
