CUTTACK: Cuttack Sadar sub-divisional judicial magistrate (SDJM) P.K. Das on Saturday accepted a petition filed by the district administration seeking to condone the delay in slapping a false affidavit case against former Union Minister and senior state Congress leader K.C. Lenka. The SDJM after accepting district administration’s plea has fixed October 28 next to decide whether to take cognisance of the main petition filed against the senior Congress leader, who unsuccessfully contested the 2004 Assembly elections from Choudwar constituency. On the basis of a complaint filed by one Harihar Parida, a native of Choudwar segment and subsequent orders from the State Chief Electoral Officer (CEO), the district administration had filed a false affidavit case against Mr. Lenka earlier this month. The Congress leader was charged with suppressing facts about his property, pending vigilance cases and educational qualification in the mandatory affidavit that every candidate was required to submit at the time of filing nomination papers. Since the case was filed in June this year even as the elections were complete in April 2004, the district administration had urged the trial court to condone the delay as investigations into the matter took long time after receiving the complaint. It may be recalled here that the SDJM had also rejected a petition filed by Mr. Parida, who was projected as the complainant against Mr. Lenka. Mr. Parida, a former students’ leader, had denied of having made any complaint against Mr. Lenka.
