Couple in one house cannot possess two LPG connections: High Court

IOC issues procedures for release of new gas connections

MADURAI: A husband and wife living under one roof can possess only one Liquefied Petroleum Gas (LPG) connection in either of their names and not two separate connections as held by many, the Madras High Court has ruled.

Disposing of a writ petition filed in the Madurai Bench, Justice G. Rajasuria said the law governing LPG connections did not permit two connections even if the spouses were availing just one cylinder through each of the connections.

The sole alternative available to couples, whose usage crossed more than one cylinder, was to file necessary applications before the authorities concerned and obtain an additional cylinder for the single connection, the Judge said.

M. Mariappan, a consumer from Aruppukottai in Virudhunagar district, had filed the writ petition against Indian Oil Corporation’s move to cancel a gas connection held by him, since 1976, on the ground that his wife was also possessing one.

Holding that there was no illegality in disconnecting petitioner’s LPG connection, the Judge asked him to file an appropriate application, seeking an additional cylinder in favour of his wife’s connection, which shall be disposed of within ten days.

The IOC Area Office in Madurai, covering 16 districts from Perambalur to Kanyakumari, has sent to its gas distributors/agencies, a set of procedures for release of new domestic gas connections and urged them to clear the ‘waiting list’ for fresh connections.

“The High Court judgment means a lot for us. We have found cases where people get multiple connections and misuse them for commercial purposes and for illegal gas filling stations. We have now issued strict procedures to be followed,” a senior official of the public sector company said on Tuesday.

New connections are to be released only to those persons who do not already possess an LPG connection from any other PSU oil company.

Standard undertaking in this respect should be obtained from all prospective customers, the IOC communication to distributors said.

While a ration card will no longer be insisted as proof of residence as per directions from the Tamil Nadu government, the gas agencies have been told to make sure that new connections are released only to applicants who produce proper identity such as passport, driving licence, PAN card, voter’s identity card, ration card, recent electricity/telephone bill, LIC policy etc.

The Madurai Area Office has started releasing new connections (with single cylinder) “and it is in the process of completing it for prospective customers who are waitlisted up to October 31.”
