NEW DELHI: Andhra Pradesh Governor N D. Tiwari on Friday moved the Delhi High Court in an appeal challenging his summoning in person in a paternity claim case, submitting that he was exempted from personal appearance in the matter under the Civil Procedure Code. A Single Bench of the Court had on November 25 summoned him in person on a suit by a person, Rohit Shekhar, seeking a direction to the Governor to accept him as his biological son. Mr. Tiwari’s counsel submitted before a Division Bench of the court comprising Justice A.K. Sikri and Justice Manmohan Singh that “grave prejudice and inconvenience shall be caused to the appellant [Mr. Tiwari] and his office in case the effect and operation of the impugned order is not stayed.” However, the Bench did not pass any interim order. It posted his appeal for hearing on December 15. The Court had refused to exempt Mr. Tiwari from personal appearance as sought by his counsel, saying that it was a family matter and he was not above the law.
