Australian challenges court jurisdiction

CHENNAI: Can a criminal court try any matter against a foreign national without obtaining the consent of the Union Government?

This question has been raised by an Australian national in a petition before the Madras High Court and Justice K.Mohanram has ordered notice.

P.V.Kamakshidasan submitted that his wife, M.Sripriya, lodged a complaint under the Cr.P.C and the Protection of Women from Domestic Violence Act before XXIII Metropolitan Magistrate, Saidapet. Pending trial, following petitions, the Magistrate granted interim relief to his wife.
