HYDERABAD: A Division Bench of the High Court comprising Justice D.S.R. Varma and Justice G. Chandriah on Thursday stayed the order of the single judge who had directed the officers of the Cooperative Department to initiate a thorough inquiry into the affairs of the Jubilee Hills Cooperative House Building Society. The Bench was dealing with a writ appeal filed by the society aggrieved by the orders of single judge who minced no words about the society and imposed costs of Rs 1 lakh. It may be recalled that one Dr. Singh, who was working in the US, complained to the society that his plot was knocked away by a woman claiming to be his sister. Later, the society transferred this plot to a third person, who claimed to be the brother of the woman. After the orders of the arbitrator and the cooperative tribunal Dr. Singh filed a writ petition in the High Court. Allowing the writ petition, Justice C.V. Nagarjuna Reddy came down heavily on the society and ordered an inquiry under Section 51 of the Cooperative Societies Act. E.Manohar, senior counsel appearing for the society, took strong exception to the wording in the judgment wherein stringent remarks were passed about the working of the society. He lamented that these findings and observations went beyond the brief. The government pleader for the Cooperation Department said no inquiry could take place on complaints if the stay was granted. The case will be listed next Thursday.
