Petition held as not maintainable

CHENNAI: The Madras High Court has held as not maintainable, a petition filed by the mother of a victim in the attack on the Tamil daily Dinakaran in Madurai last year seeking permission to present a complaint pertaining to the incident before any metropolitan magistrate court in Chennai.
Passing orders on the petition, Justice K. Mohanram said it was not maintainable before the Principal Seat. The petitioner was at liberty to present the same before the permanent Bench of the High Court in Madurai.
Thilagavalli (50) of Paravai in Madurai submitted that her son G. Gopinath, who was an employee of the newspaper, and two others died in the incident on May 9, 2007.
The Othakadai police registered three cases, but there was no proper investigation. Later, the case was handed over to the CBI, which had filed the charge sheet. She said grave injustice had been caused to the innocent public, particularly to her, by not impleading the main accused. She said there were several eye-witnesses to the incident. Her complaint before the Judicial Magistrate at Melur was returned.
She filed a petition before the High Court Madurai Bench and that was also returned asking her to state how the petition was maintainable.
