Construction of a drain: resident firm on fight to finish

Court urged to issue show cause notice to the executive officer

BERHAMPUR: Berhampur may boast to have become the third municipal corporation in the State but it brings least respite for people like Basanta Kumar Mohanty who is fighting legal battle since more than 15 years for construction of a drain near his home by the municipality.

When his repeated requests to the local municipality to have a drain near his home at Utkal Ashram Road failed he approached the court of the Berhampur sub-divisional Magistrate cum sub-collector for the purpose in September 1993.

The legal proceedings took their own course and Mr. Mohanty was able to get an order from this court in August 2006.

The order could be achieved only due to my prolonged and continuous efforts in the court, said Mr. Mohanty.

According to him usually people forget to pursue such cases due to long delays which he did not do.

The order of the sub-divisional magistrate in 2006 asked the executive officer of the Berhampur municipality to complete construction of the drain within a year of the date of court order on Aug. 8, 2006.

The court directed the executive officer to construct the drain observing all formalities and taking up necessary eviction.

But more than two years have passed since that court order but no steps have been taken for the construction of the said drain, although the court had given a time frame of one year.

The petitioner Mr. Mohanty made several personal approaches to the municipal authorities during the period showing the court order without any avail.

Till now the municipality has not earmarked any funds for the purpose of constructing the said drain.

Having no other way out Mr. Mohanty has again approached the court of Berhampur sub-divisional Magistrate cum sub-collector demanding the court to intervene and order for implementation of previous court order of 2006 which was violated by the municipal authorities.

He also urged the court to issue a show cause notice to the executive officer of the Berhampur municipality as to why legal proceedings should not be initiated for this disobedience of law of the land.
