“Ad hoc employee has right to move labour court”

NEW DELHI: The Delhi High Court has ruled that an ad hoc employee also has the right to move a labour court in case of any dispute with his or her employer, and the court has enough powers to pass directions on them under the Industrial Disputes Act.

A Division Bench of the Court gave this ruling while rejecting a submission by the Delhi Development Authority (DDA) that an ad hoc employee cannot move a labour court in case of any dispute with his or her employer as he or she was not covered under the Act. The DDA made this submission while opposing a appeal by the widow of an ad hoc employee seeking a direction to it to give a job to her son on compassionate grounds.

The widow had filed the appeal challenging an order by a Single Bench of the Court quashing an order by a labour court here asking the Authority to give a job to Sudesh, the son of the deceased.
