Court to pass order today in ‘false affidavit’ case

Criminal complaint filed against Goa Minister Babush Monseratte


Social activist has in his compliant said the Minister has passed only seventh standard

Police submit report saying the Minister has not produced any document on his stand


PANAJI: Panaji Chief Judicial Magistrate Crisanto Fernandes will pass an order on Thursday whether to issue process against Goa’s Education Minister Babush Monseratte on the criminal complaint filed by social activist Aires Rodrigues against in a “false affidavit” case.

The Minister is facing a court case for having allegedly filed a false affidavit in the May 2007 Assembly elections that he had a SSC and also a false declaration to the Goa Legislative Secretariat that he was S.Y.BA, though he had only passed the 7th Std.

The Chief Judicial Magistrate has heard arguments advanced by the petitioner who has in written arguments has prayed that process be issued and Mr. Monseratte be lead to trial in accordance with law for “filing a false affidavit”.

As directed by the Chief Judicial Magistrate, the Panaji Police have investigated the complaint against Mr. Monseratte and submitted a detailed report to the court.

The police, in its report, told the court that the Principal of St. Theresa’s High School, Mumbai, by certificate issued on October 10, 2008 has stated that Mr. Monseratte had taken admission in St. Theresa’s High School on June 19, 1975 in Standard VI and that he had left school in Standard VIII on September 7, 1978.

The police also told the court that by letters of October 16, 2008 and October 21, 2008 Mr. Monseratte was requested to give a convenient date and time to record his statement but failed to reply to the notice and also failed to go to the police station.

However, Mr. Monseratte, through a written reply on October 23, 2008 denied that he has filed any false affidavit and has stated that he has completed SSC. Mr. Monseratte has also stated that after leaving St. Theresa’s High School, he studied in other schools. The police have said that though Mr. Monseratte, in his statement of October 23, 2008, has stated that he has passed SSC, he has not produced any document to support that statement.
