Defence for Ajmal

This refers to the report that the special court has revoked the appointment of Anjali Waghmare as the defence lawyer of Ajmal Amir Iman ‘Kasab,’ because of a conflict of interest. The same lawyer representing a victim as well as the perpetrator of a crime sounds incongruous. I wonder why it did not occur to Ms Waghmare that this defies simple common sense and is not acceptable in law.

At a time when Pakistan is using all kinds of diversionary tactics to obscure the role of its nationals in the 26/11 attack, the Mumbai police’s mixing up of the DNA records and Ms Waghmare’s act of seeking to be both the prosecutor and the defence lawyer have done immense damage to the case so carefully built against the perpetrators of the worst crime. Despite knowing that her client, a victim of the Cama Hospital attack, is a witness in the case against ‘Kasab,’ the lawyer chose not to disclose it. This is a body blow to the legal community, even if it is an isolated instance.

Why was Ms Waghmare, wife of a police officer, appointed as Ajmal’s defence lawyer in the first place? Her husband belongs to the same department that lost many of its officers and constables during the Mumbai terrorist attack. Is that not a conflict of interest?

For all facts and purposes, this is an open and shut case. It is in the interest of all that the case is tried quickly and justice meted out fairly and swiftly.

When Ms Waghmare came forward to defend ‘Kasab’, despite the Shiv Sena’s attack on her house, she came in for high praise. But what we see now is another issue of professional misconduct, resulting in her removal as Ajmal’s advocate. She perhaps thought she could have the cake and eat it too by representing both the offender and the offended.
