Discretionary powers of sub-registrars removed

Documents required for the purpose have been listed


BANGALORE: In order to make the process of registration of property easier, the Government has come out with a list of documents required for the purpose, thus removing the discretionary powers of sub-registrars.

Bringing uniformity across the State, the Revenue Department, through a Government Order, has issued guidelines to sub-registrars. This follows directions from the Karnataka Information Commission to the Inspector-General of Stamps and Registrations and the Revenue Department.

“The guidelines will also help in preventing harassment of citizens as the discretionary powers given to the sub-registrars have been removed,” a senior official in the Revenue Department told The Hindu. “After the Supreme Court struck down Section 22 (A) of the Registration Act in 2005, there was no uniformity in the documents required to register properties, and registrations were being done haphazardly,” the official said.

The official also pointed out that the guidelines would prevent haphazard growth of cities since properties without proper documents would not be registered.

Documents required

If you are registering property coming under the jurisdiction of the Bruhat Bangalore Mahanagara Palike or any of the corporations in the State, six documents are needed. They are: copies of the khata and tax determination receipt issued by the BBMP or corporation; an affidavit; conversion certificate or sanction plan if the properties are on converted land; title deed/allotment order/possession certificate/sale document if the property has been given by government department or agencies; PAN issued by Income Tax Department or a declaration in form 60 and 61 if the value of the property is more than Rs. 5 lakh; declaration in form 1 under the Karnataka Stamps (Prevention of Undervaluation of Properties) Rules, 1977.

Same set

The same set of six documents issued by the appropriate authorities is required to register properties in gram panchayats, town panchayats, municipalities and municipal councils. For registration of agricultural land, an affidavit; declaration in form 1 under the Karnataka Stamps (Prevention of Undervaluation of Properties) Rules; RTC; declaration under Section 81-A of the Land Reforms Act; survey sketch of the land; PAN; and no-objection certificate from the appropriate authority under Section 6 of Karnataka SCs/STs Act, 1978 that prohibits sale of certain lands have to be submitted.
