Call for adapting laws for global markets

seeks ARBITRATION: The Chief Justice of the Kerala High Court, Justice S. R. Bannurmath, inaugurating a national conference on ‘Maritime Arbitration: Techniques and enforcement’ in Kochi on Saturday. The conference is being organised by the Indian Council of Arbitration and the Kerala Chamber of Commerce and Industry.

KOCHI: Chief Justice of Kerala S.R. Bannurmath has underlined the need to ensure that Indian laws are adapted to the needs of global markets and cross-border transactions.

The domestic laws cannot provide solutions to the problems of international commerce and a proper reform of Indian commercial law is warranted.

He was inaugurating a conference on “Maritime arbitration: techniques and enforcement,” organised by the Kerala Chamber of Commerce and Industry here on Saturday.

He said institutional arbitration should be adopted instead of ad hoc arbitrations. Availability of pre-established rules and arbitrators as well as administrative assistance from institutions would be among the advantages of the former.

The approach of the legal fraternity should not be to convert the proceedings before arbitration into one before ordinary civil court.

The arbitrators and the lawyers had to change their mindset to avoid delayed settlement.
