Government to appoint prosecutors on contract basis

BANGALORE: The State Government on Friday informed the Karnataka High Court that it would take expeditious steps to fill up vacancies of posts of assistant public prosecutors, additional public prosecutors and public prosecutors in all the courts in Karnataka. Advocate-General (AG) Ashok Haranahalli gave this undertaking on behalf of the government to a Division Bench comprising Chief Justice P.D. Dinakaran and Justice V.G. Sabhahit. The Bench was hearing a suo motu public interest litigation (PIL) petition initiated by the High Court asking the government to fill up posts of prosecutors and advocates in criminal and civil courts.

Filing a report, the AG said the posts of assistant public prosecutors would be filled on contract. He said the Principal District and Sessions Judge of each district could suggest a panel of names for appointment to the posts of prosecutors. The government, in turn, would look into the issue and make appointments expeditiously.

The High Court had taken up the suo motu PIL petition after it had compiled a report on the number of posts and vacancies in all the courts in the State. According to the report, five lakh civil and criminal cases are pending in district and munsiff courts. Charges are yet to be framed in 47,1245 cases and 23,800 accused are still absconding. In all, 52,194 bailable warrants are yet to be executed. Similarly, the number of pending land acquisition cases are 29,554.

The Bench had on Thursday sought to know the reason for the delay by the State Government in filling up posts and asked the AG to file a report. With the report being filed in the court, the Bench adjourned further hearing of the case to Tuesday.
