Court stays order on NICE acquisition

BANGALORE: The Karnataka High Court on Wednesday stayed a single judge order permitting Nandi Infrastructure Corridor Enterprises Ltd. (NICE) to acquire two acres of land in Kengeri village, Kengeri, Bangalore South taluk, for the Bangalore-Mysore Infrastructure Corridor Project (BMICP).

A Division Bench comprising Justice A.S. Bopanna and Justice Aravind Kumar passed the order on an writ appeal by Mr. Parthasarthy, who had questioned the single judge order of September 14, 2009, upholding the acquisition of his land for BMICP. The single judge had held that any defect in the preliminary notification will not prove fatal for acquisition proceedings as long as it specifies the survey number and provides sufficient opportunity to the persons to put in their objections. In his appeal, Mr. Parthasarthy said his lands had initially not been marked for acquisition.
