The case pertains to his snatching away of records from a PA to the Assistant Collector CHENNAI: The Madras High Court on Monday ordered stay of criminal proceedings pending before the Judicial Magistrate, Coonoor, against a person who filed a ‘vakkalath’ on behalf of the manager of the Kodanad Tea Estate. Notice orderedJustice T. Sudanthiram passed the interim order on a petition filed by M.K. Elangovan of Sivanpuram Colony, Mettupalayam. Admitting the petition, he ordered notice. In his petition, Mr. Elangovan stated that the Coonoor police had filed a charge sheet against him for offences under Sections 204 (Destruction of document to prevent its production as evidence) and 353 (Assault or criminal force to deter public servant from discharge of his duty) Indian Penal Code. The case pertained to his snatching away of records and evidence recorded by a Personal Assistant to the Assistant Collector when proceedings under Section 138 (Procedure where he appears to show cause) Cr.P.C. were under way before the Sub-Divisional Magistrate, Coonoor. The Personal Assistant was recording the evidence of Panthose. The petitioner said at that time he filed a ‘vakkalath’ on behalf of the estate manager. He snatched away the records from the Personal Assistant. Seeks dischargeThe petitioner said he filed a petition before the magistrate court seeking discharge. The magistrate dismissed the petition. Hence, the present petition.
