No permission sought from Centre

Suspension of IAS officer K. Suresh Kumar

Kochi: The Union government on Friday informed a Division Bench of the Kerala High Court that the State government had not sought its permission to keep K. Suresh Kumar, IAS officer, under suspension beyond 90 days from the date of suspension without initiating disciplinary proceedings against him.

When the appeal filed by Mr. Suresh Kumar against the verdict of the Central Administrative Tribunal came up for hearing before the Bench comprising Justice Kurian Joseph and Justice C.T. Ravikumar, T.P.M. Ibrahim Khan, Assistant Solicitor General of India, also submitted that the State government did not appear to have made any request to the Union government explaining the circumstances for not initiating disciplinary proceedings within the mandatory 90 days of his suspension.

Mr. Suresh Kumar, managing director, State Cooperative Bank for Agriculture and Rural Development, was placed under suspension for criticising the functioning of the Chief Minister’s Office (CMO). He pointed out that as per Rule 3(1) of the All India Services (Discipline and Appeal) Rules, 1969, if no disciplinary proceedings were initiated or commenced before the expiry of 90 days from the date of suspension, the suspension would be invalid. The suspension order was issued on December 11, 2008, and the 90-day period expired on March 10, 2009.
