CHENNAI: The Madras High Court has quashed two cases registered at the Saravanapatti police station in Coimbatore district, in which eight persons, including four advocates, were said to have been involved. In his order on two petitions filed by advocates E. Gokulakrishnan and E. Sankar, seeking to quash the complaints, Justice P.R. Shivakumar said it was a clear case of mala fide on the part of not only the de facto complainants in both the cases, but also the police officers, who had initiated the proceedings with an ulterior motive of coercing Jayanthi of Government Employees Quarters, Ganapathy, Coimbatore, to withdraw a complaint given by her against the Sub-Inspector of Police, Saravanapatti. The registration of the cases was with a motive to wreak vengeance on the accused. The court said it was quashing the complaints not only against the petitioners, but also in their entirety against all the persons cited as accused. Petitioner’s counsel S. Prabakaran said there were several discrepancies in the FIR, which would make out a case of clear concoction and abuse of process of law. Government Advocate I. Paul Nobel Devakumar said that a criminal case could not be quashed at the initial stage on the ground that the allegations made in the complaint were not true.
