Directive to pay compensation

Kochi: The Consumer Disputes Redressal Forum, Ernakulam, has directed SBI Card to pay a compensation of Rs.25,000 to a complainant for the mental agony suffered by him due to persistent demands for non-existing dues.

The forum, headed by president A.Rajesh, also directed SBI Card to pay the complainant Rs.1,000 as cost.

The order was passed on a complaint filed by V.K. Nandakumara Menon of Thammanam. According to him, he had received an unsolicited SBI credit card with an offer of a loan of Rs.8,000 interest-free in the first month and at 2 per cent interest in the subsequent months. The complainant had utilised the offer and paid back the loan with interest. However, SBI Card kept the cheque for three weeks. Thereafter they started demanding Rs.450 every month. Ultimately, the complainant and the opposite party reached a settlement and agreed to pay Rs.200 towards full and final settlement. Even after that, the complainant started receiving statements demanding payments. Besides threatening him over phone, the opposite parties had issued lawyer’s notice to the complainant.

The forum observed that SBI Card had threatened the complainant, a senior citizen and a physically challenged person, on various occasions. Moreover, they had sent monthly statements demanding exorbitant amounts though there was no outstanding due from the complainant.
