Centre, State told to explain dropping of charges against Baalu

CHENNAI: The Madras High Court has directed the State and Central governments to state as to why criminal proceedings already instituted against T.R. Baalu, now MP (Union Minister in 2001) were ordered to be dropped.
A Division Bench comprising Justices S.J. Mukhopadhaya and M. Duraiswamy passed the order on a petition, filed in 2001, by Dwarakanathan of Erode.
The petitioner alleged that when the police went to the residence of M. Karunanidhi on June 30, 2001 (to arrest him in the ‘flyover scam case’) they were assaulted by the then Union Minister, Murasoli Maran. The then DIG, CB CID, A.P. Mohamed Ali, lodged a complaint with the Mylapore police. When the police team went to Maran’s house in search of M.K. Stalin, Mr.Baalu, with 25 other persons, abused the police and restrained their entry into the house.
The Royapettah police registered a case in this regard. The petitioner said all these were evident from video clips of private television channels and that of police.
While so, the then Union government directed the State government to drop all proceedings against the two Union Ministers and the Sun TV. Following instructions from the State government, the police withdrew the cases.
The petitioner prayed the court to restrain the Central and State governments from issuing any direction to other respondents restraining them from investigating the criminal proceedings.
