Release of female life convict ordered

MADURAI: The Madras High Court Bench here showed mercy on a woman undergoing life sentence for crushing her husband to death with a boulder and ordered her release after holding that the murder had taken place because of sustained provocation by the victim.

Allowing a criminal appeal filed by the mother of four, Justices R. Regupathi and R. Subbiah modified her conviction from Section 302 (murder) to Section 304 (culpable homicide) of the Indian Penal Code and held the imprisonment already undergone was sufficient punishment.

The judges pointed out that the convict was tortured by her husband continually for years together.

He had threatened to do away with her on many occasions and also stabbed her on the right hand three months before his death.

Further, he had illicit intimacy with another woman of the same village.
