HYDERABAD: The government has waived the 10 per cent penalty on the total project cost of building the Punjagutta flyover imposed against the contractor, Gammon India Limited and the technical consultant, Tanikella Integrated Consultants. The penalty was recommended by a technical committee headed by Engineering Chief of Roads & Buildings K. Siva Reddy when two persons were killed and nine injured after eight segments crashed on the road below on July 9, 2007. It also asked the contractor to bear all costs concerned with the loss of individuals and properties – public or private. In orders passed on Monday, Municipal Administration & Urban Development Principal Secretary Pushpa Subrahmayam, said that the government had examined the committee recommendations and is of the view that as per the agreement contract signed between Gammon India and MCH, the liability of the contractor was limited payment of compensation to the dead or injured or damage caused to the public property. And the contractor had paid Rs. 1.48 crore as compensation for the mishap and imposition of any penalty was not valid before the law. Gammon India has pointed out that continuous heavy downpour caused the incident. Tanikella Consultants represented that the accident was due to natural calamity and due to laying of a new pipeline against its advice, hence, it could not be held responsible and sought the penalty waiver.
