Crack down on unrecognised schools: court

CHENNAI: The Madras High Court has asked the State government to direct district educational authorities to take action against school authorities which start institutions without any affiliation or recognition.

Justice K. Venkataraman, who made the observation, pulled up the Educational authorities in Nagapattinam district for not taking action against the Assembly of Jesus Christ Public School, a minority institution, which had been functioning from 2007 without recognition from the State government or affiliation from the Central Board of Secondary Education (CBSE).

The district authorities had passed an order December 4, 2009 directing the school correspondent to close down the school, which had 487 students, 25 teaching staff members and seven non-teaching staff.

Two writ petitions were filed by the correspondent and the parents association of the school challenging the order and to allow the school to continue functioning till the end of the current academic year.

The judge, who dismissed the petitions, said the State government, represented by the Secretary School education, Director of School Education, District Collector of Nagapattinam and Chief Educational Officer of the district, should take earnest and immediate steps to accommodate the students in nearby schools without affecting their studies.

The judge said Section 11 of the Tamil Nadu Recognised Private Schools (regulation) Act, 1973 clearly said that recognition of a competent authority was necessary for the functioning of a school. He also said that the Affiliation Bye-Laws of the CBSE state that schools seeking provisional affiliation with the Board must have formal prior recognition of the State government.He said the school could not be permitted to run without recognition from the State government and without affiliation by the CBSE board.
