“The administrative action against the responsible Army officers is a mockery of justice” NEW DELHI: The Delhi High Court on Thursday granted a compensation of Rs.10.5 lakh to the family of an Army Naib who had mysteriously disappeared 18 years ago and never returned following mental torture by his superior officers. A Division Bench of the Court comprising Justice A. K. Sikri and Justice Ajit Bharihoke granted the compensation on a petition filed by Savitri Sharma, wife of Naib G. N. Sharma. The Naib was posted in Pathankot under Colonel Bikramjit Singh. His duty was to do religious teaching. However, the Colonel had removed him from his assigned job and asked him to work at his residence. When the Naib refused to do so, the Colonel purportedly threatened him with dire consequences. The Naib lodged a complained against the Colonel to the Brigadier but got no relief. After some time, he disappeared under mysterious circumstances and never returned. Granting the compensation, the Bench said, “Insofar as claim for compensation is correct, we are of the opinion that it is well founded. The harassment and cruel treatment meted out to Sharma and his family members, including the petitioner herein, have led to the disappearance of Sharma….Army senior officers are supposed to give a helping hand to their subordinates.” About the administrative action taken against the responsible Army officers, the Bench said: “The violators have virtually been let off as the administrative action taken against them is a mockery of justice.”
