Retirement age: case adjourned

Kochi: The Kerala High Court on Tuesday adjourned hearing on a writ petition challenging the government order enhancing the retirement age of government medical college teachers from 55 to 60.

The petition was filed by M.M. Parameswaran, a former teacher of the Vaidyaratnam Ayurveda College, Ollur. The petitioner said the order was arbitrary and illegal. The order was passed without amending relevant rule in the Kerala Service Rules. He also contended that refusing to extend the benefits of the order to Ayurveda college teachers was discriminatory.

He said if the rules were amended, the petitioner and similar other persons could have had the benefits of the government order which was implemented with retrospective effect from May 1, 2009. The petitioner pointed out that the government had to function within the parameters of the Constitutional mandate. Service benefits to employees could not be treated as the benevolence granted by the party in power.

In fact, the conditions of service, eligibility for appointment and promotion were determined on the basis of the Central legislation.
