APAT order on D.Ed. candidates upheld

Government had amended rules providing for 30% quota for D.Ed. candidates

B.Ed. candidates challenged this rule in APAT but their cases were dismissed


HYDERABAD: A Division Bench of the High Court comprising Justice G. Raghuram and Justice R. Kantha Rao on Monday expressed disinclination to interfere with the orders passed by the Andhra Pradesh Administrative Tribunal (APAT) directing the government to reserve 30 per cent of the SGT teacher posts for D.Ed. candidates.

The Bench dismissed the writ petition filed by the government challenging the interim orders of APAT.

The APAT had passed interim orders directing the government to provide 30 per cent of SGT posts to D.Ed. candidates. The government through its Principal Secretary, School Education, filed the writ petition challenging the interim directions.

It argued that the case of reservation for D.Ed. candidates was pending with the Supreme Court and APAT cannot issue such interim directions.

Better trained

D.Ed. candidates have been agitating for special quota in the SGT posts, contending that they are better trained to teach the primary sections. The government had brought in amendment of the rules providing for 30 per cent reservation for D.Ed. candidates. The candidates holding B.Ed. degree challenged this rule in APAT and their cases were dismissed.

They approached the High Court which struck down this rule of reservation for D.Ed. candidates and the matter was carried to the Supreme Court.

The Supreme Court stayed the operation of the order of the High Court. When these cases were going on, the government argued that this amendment was applicable to 2008 recruitment too.

Interim orders

Based on the stand of the government and the interim orders of the Supreme Court, the APAT granted interim orders recently.

When the government filed the writ petition challenging the order of APAT, the bench wondered how the government could take a different stand now.
