Government gets notice over Shubha's plea

BANGALORE: The case of Shubha, an advocate of Bangalore, who was sentenced to life imprisonment for the murder of her fiancée in Bangalore on December 2, 2003, came up for hearing before the Karnataka High Court on Friday.

Shubha was the only one among the four convicted who has so far filed an appeal against a judgment of a lower court in Bangalore.

Shubha's advocate C.V. Nagesh argued for setting aside the judgment of the 17 {+t} {+h} Fast Track Court (FTC) which had on July 14, 2010 sentenced Shubha along with Arun Verma, Dinesh alias Dinakar and Venkatesh, to life imprisonment for the murder of B.V. Girish, an employee of a software firm, at Air View Point on Domlur-Kormangala Ring.

She said the lower court had erroneously held her guilty of the murder. She alleged that the lower court had failed to appreciate the fact that it was she who had taken Girish to Manipal Hospital and informed their parents about the murderous attack on Girish,

A Division Bench comprising Justice K. Sreedhar Rao and Justice Arali Nagaraj orally said it would not at this point of time consider the application for suspension of sentence.

Instead, it suggested that the matter could be posted for final hearing from August 4.

The Bench ordered issue of notices to the State and Viveknagar police . It adjourned hearing of the case to August 4, 2010.
