Commissioner of Prohibition Circular stayed

CHENNAI: The Madras High Court on Tuesday granted interim stay of the operation of a circular of the Commissioner of Prohibition and Excise of March this year.
Justice N.Paul Vasanthakumar passed the interim order on a petition by the Madras Gymkhana Club. In its petition, filed through counsel Abudu Kumar Rajaratnam and S. Ashok Kumar, the club, represented by its secretary, P.V.S.Venkata
subramaniam, said it held a licence under section 17-C of the Tamil Nadu Prohibition Act for possession of liquor by a non-proprietary club for supply to its members. By a circular dated March 23, the Commissioner of Prohibition and Excise citing Rule 34 (2) of the Tamil Nadu Liquor (Licence and Permit) Rules instructed all F.L.2 licensees not to permit members of the club or their guests to consume liquor brought from outside the club within the club premises.
This caused grave prejudice and hardship to the petitioner club and its members.
This circular was sought to be made applicable only to proprietary clubs holding FL 2 licences and not star hotels.
