Court orders removal of seal on 3 drug firms

CHENNAI: The Madras High Court on Wednesday directed the authorities to remove the seal put by them on three business premises doing wholesale business in drugs, and permit the sale of drugs for which the expiry period is not over and which are not identified as spurious drugs.

Justice N.Paul Vasanthakumar gave the direction in his common order on petitions filed by V.Meenakshisundaram, against whom the Kodungaiyur police had registered a criminal case in connection with alleged spurious drugs, based on a complaint by the Inspector of Drugs in March this year, and by his wife N.M.Sathammal.

The judge also permitted the petitioners to sell the unobjectionable drugs after getting clearance from the Drugs Inspector concerned. Mr.Justice Paul Vasanthakumar made it clear that in view of the disposal of the writ petitions, none of the legal submissions by the petitioner's counsel was decided in any manner in his order.

The merits of contentions raised in the petitions were left open to be decided in any proceedings, which may arise in future or in the criminal case and the same would have to be decided in accordance with law.

He also ordered that the bank accounts of the three concerns, which were frozen on March 16 this year, be released by the authorities forthwith.

The petitioner submitted that the three premises, Vasantha Enterprises, Vasanthameena Enterprises and Meena Health Care Pvt. Ltd, all at Chinmaya Nagar, were doing wholesale business in drugs after obtaining licence under the Drugs and Cosmetics Act.

Petitioner's counsel, N.Jothi, argued that the Kodungaiyur Police and the Drug Inspector, Perambur range, lacked power in sealing the premises and freezing the bank accounts.
