New Delhi: A court here has acquitted 16 persons of charges of rioting and culpable homicide not amounting to murder (IPC Section 304) in a case in which one died of injuries received in a brawl inside a Delhi temple in 2006. “The incident, though, points fingers against some of the accused. However, mere suspicion is not enough to drive home the guilt of the accused,” District and Sessions Judge S. P. Garg said. The court, however, rapped the police for their faulty probe in the case. “No call details of mobile phones of the accused persons were collected at any stage of the investigation by the police to point out that they were in touch with one another regarding the incident,” it said. According to the prosecution, on October 22, 2006, all 16 accused armed with iron rods trespassed into a temple and beat up the three brothers, Het Ram, Gautum and Tarun Kumar. Later, Het Ram died of injuries at AIIMS. Giving benefit of doubt to the accused, the court said it was not proved that they had come again inside the temple to kill the victim. It said that Tarun and Gautam supported the case but improved upon their earlier statements which created a doubt about their allegations. - PTI
